(Cap 459 section 23) [1 April 1995] (L.N. 116 of 1995) Cap 459A s 1 (Omitted as spent) PART I PRELIMINARY (Omitted as spent) (Enacted 1995) Cap 459A s 2 Interpretation In this Regulation- "ancillary worker" (助理员) means any person, other than a care worker, health worker or nurse, employed by an operator whose duties include those of a cook, domestic servant, driver, gardener, watchman, welfare worker or clerk; "care worker" (护理员) means any person, other than an ancillary worker, health worker or nurse, employed by an operator to render personal care to residents; "health worker" (保健员) means any person whose name appears on the register maintained by the Director under section 5; "home manager" (主管) means any person responsible for the management of a residential care home; "infectious disease" (传染病) has the same meaning as in the Quarantine and Prevention of Disease Ordinance (Cap 141); "nurse" (护士) means any person whose name appears on- (a) the register of nurses maintained under section 5 of the Nurses Registration Ordinance (Cap 164); or (b) the roll of enrolled nurses maintained under section 11 of that Ordinance;"operator" (经营者) means a person to whom a certificate of exemption has been issued under section 7 of the Ordinance or a person to whom a licence has been issued under section 8 of the Ordinance; "particulars of identity" (身分详情) means the particulars set out on an identity card issued under the Registration of Persons Ordinance (Cap 177). (Enacted 1995) Cap 459A s 3 Types of residential care homes PART II TYPES OF RESIDENTIAL CARE HOMES For the purposes of sections 7(3)(c) and 8(4)(c) of the Ordinance, a residential care home may be classified as- (a) a "care and attention home" (高度照顾安老院) namely, an establishment providing residential care, supervision and guidance for persons who have attained the age of 60 years and who are generally weak in health and are suffering from a functional disability to the extent that they require personal care and attention in the course of daily living activities but do not require a high degree of professional medical or nursing care; or (b) an "aged home" (中度照顾安老院) namely, an establishment providing residential care, supervision and guidance for persons who have attained the age of 60 years and who are capable of observing personal hygiene but have a degree of difficulty in performing household duties related to cleaning, cooking, laundering, shopping and other domestic tasks; or (c) a "self-care hostel" (低度照顾安老院) namely, an establishment providing residential care, supervision and guidance for persons who have attained the age of 60 years and who are capable of observing personal hygiene and performing household duties related to cleaning, cooking, laundering, shopping and other domestic tasks. (Enacted 1995) Cap 459A s 4 Qualifications for registration as a health worker PART III REGISTRATION OF HEALTH WORKERS A person who- (a) has completed a course of training approved by the Director in writing either generally or in any particular case; or (b) by reason of his education, training, professional experience and skill in health work satisfies the Director that he is a suitable person to be registered as a health worker under section 6,shall be qualified to be registered as a health worker for the purposes of employment at a residential care home. (Enacted 1995) Cap 459A s 5 Register of health workers (1) The Director shall establish and maintain a register in which he shall cause to be kept particulars of the names and addresses of all persons registered as health workers under this Regulation and such other matters, if any, as he thinks fit. (2) The register shall be available for inspection by the public free of charge at such offices of the Government as the Director may direct, during the hours when those offices are open to the public. (3) The Director shall enter in the register any amendment as he may consider necessary for the purposes of preserving the accuracy of the register in respect of the address or any other particulars relating to a person whose name appears therein. (4) The Director shall remove from the register the name of a person- (a) who dies; (b) who requests in writing that his name be removed; or (c) whose registration is cancelled under section 8. (Enacted 1995) Cap 459A s 6 Application for and registration as a health worker (1) An application by a person for registration as a health worker shall be made in such form and manner and be accompanied by such particulars as the Director may determine. (2) Subject to subsection (3) and on payment of the fee prescribed in section 38, the Director may, in his discretion, register a person as a health worker, and may impose such conditions in relation to that registration as he thinks fit. (3) The Director shall not register an applicant as a health worker unless he is satisfied that the applicant is a person who is- |
