(Cap 478 sections 133 and 134) [2 September 1996] L.N. 342 of 1996 (L.N. 239 of 1996) Cap 478AB s 1 (Omitted as spent) (Omitted as spent) (Enacted 1996) Cap 478AB s 2 Interpretation In this Regulation, unless the context otherwise requires- "hourly rate" (按小时收费率) means the rate per hour calculated in accordance with section 8; "office hours" (办公时间) means the hours between 9 a.m. and 5 p.m., and 9 a.m. and noon on Saturday, excluding general holidays within the meaning of the General Holidays Ordinance (Cap 149); (35 of 1998 s. 5) "surveyor" (验船师) means a person appointed under section 5(1) of the Merchant Shipping (Safety) Ordinance (Cap 369) to be a Government surveyor; "tons" (吨) means gross tons, and in the case of a ship having alternative gross tonnages, the larger of those gross tonnages, as calculated in accordance with the Merchant Shipping (Registration) (Tonnage) Regulations (Cap 415 sub. leg.). Cap 478AB s 3 Schedule of fees (1) Subject to section 5(1), the fees prescribed in the Schedule shall be payable in respect of the matters specified in relation thereto in that Schedule. (2) Except where otherwise specified in the Schedule or by necessary implication, the fees prescribed for the issue of any certificate shall be in respect of a certificate valid for a period of 12 months. (Enacted 1996) Cap 478AB s 4 Fees for services within Hong Kong Where the issue of any certificate or clearance is dependent upon the carrying out of any survey or inspection within Hong Kong during office hours, any fee prescribed by this Regulation shall include the services of a surveyor together with any travelling or other expenses involved. (Enacted 1996) Cap 478AB s 5 Fees for services outside Hong Kong (1) Where the issue of any certificate or clearance is dependent upon any survey or inspection to be undertaken outside Hong Kong by a surveyor sent from Hong Kong for that purpose, there shall be payable- (a) a fee calculated in accordance with subsection (2); and (b) the travelling and subsistence expenses of the surveyor in such reasonable sum as the Authority shall determine.(2) For any survey or inspection described in Part I of the Schedule, the fee payable shall be- (a) where the fee for the services is entirely determinable by the time involved, the sum of $7645, in lieu of an hourly rate, for each period of 24 hours or part thereof during which the surveyor is absent from Hong Kong on account of the survey or inspection; (b) where the fee for the services is not determinable by the time involved, the sum of $15290 for the whole period during which the surveyor is absent from Hong Kong on account of the survey or inspection, and in addition, the relevant fee specified in that Part; (c) where the fee for the services is partly determinable and partly not determinable by the time involved, the aggregate of- (i) for the services determinable by the time involved, the sum of $7645 for each period of 24 hours or part thereof during which the surveyor is absent from Hong Kong, less the actual number of hours the surveyor is required to undertake that particular survey or inspection referred to in subparagraph (ii); and (ii) for the services not determinable by the time involved, the relevant fee for the services specified in that Part.(3) The duration of a surveyor's absence from Hong Kong shall be calculated with reference to the departure time and arrival time from and at Hong Kong. (4) Where part of the survey or inspection undertaken by a surveyor is done within Hong Kong and part of it is done outside Hong Kong, the fee payable for each part shall be calculated according to section 3 and this section respectively. (Enacted 1996) Cap 478AB s 6 Fees for transmission of documents Where in connection with any service specified in Part I of the Schedule or the issue of a certificate specified in Part I of the Schedule it is, in the opinion of the Authority, necessary to incur expense to transmit information, plans, calculations or other documents to places outside Hong Kong by post, telegram, telex, facsimile or similar means, there shall be payable in addition to the fee specified in Part I of the Schedule the expense involved. (Enacted 1996) Cap 478AB s 7 Fees for services outside office hours Except in the case of a service rendered by the Office, where the issue of any certificate or clearance is dependent upon any survey or inspection or where any other service is required to be undertaken by an officer of the Marine Department outside office hours, there shall be payable, in addition to the appropriate fee specified in this Regulation and the Schedule, if any, a fee in respect of each officer based upon the following scale- On week-days- (a) between the hours of 7 a.m. and 9 a.m. or 5 p.m. and 7 p.m. } $1115 per hour or part hour; (b) before 7 a.m. or after 7 p.m. } $2215 per hour or part hour; On Saturdays (after noon), Sundays or Public Holidays |
