CAP 1038 NORTH POINT WHARVES LIMITED ORDINANCE


  To authorize the making of by-laws by the North Point Wharves, Limited.
  
  [29 April 1949]
  
  (Originally 19 of 1949 (Cap 303 R. Ed. 1950))
  
  Cap 1038 s 1 Short title
  
  This Ordinance may be cited as the North Point Wharves Limited Ordinance.
  
  Cap 1038 s 2 Interpretation
  
  (1) In this Ordinance and any by-laws made thereunder, unless the context otherwise requires-
  
  "company" (北码公司) means the North Point Wharves, Limited, its successors and assigns;
  
  "official" (职员) includes only the persons acting in the following capacities in the employment of either the person, firm or company for the time being acting as general managers and/ or agents, or of the company, namely managing director, general manager, manager, marine superintendent, secretary, shipping manager, assistant shipping manager, chief clerk, accountant, wharf manager, assistant wharf manager, berthing master, engineer, wharfinger, cargo superintendent, or wharf police officer.
  
  (2) For the purposes of this Ordinance, if the Chief Secretary for Administration gives notice in the Gazette that any person, firm or company is acting as the general managers or agents of the company, such person, firm or company shall be deemed to be so acting from the date of such notice so appearing until revocation by the Chief Secretary for Administration of such notice is published in the Gazette.   Cap 1038 s 3 By-laws
  
  Remarks:
  
  Adaptation amendments retroactively made - see 61 of 2000 s. 3
  
  (1) The company shall have power, subject to the approval of the Chief Executive in Council, to make by-laws in connection with the conduct of its business at the wharves and godowns belonging to the company and situate at North Point, and the maintenance of order and safety thereon, and such by-laws may prohibit, conditionally or otherwise, the usage by passengers or by the public of the godowns, buildings, wharves, roads and premises of the company. (Amended 9 of 1950 Schedule; 61 of 2000 s. 3)
  
  (2) A copy of the by-laws so made clearly printed in English and Chinese shall be posted in a conspicuous place on the premises.
  
  Cap 1038 s 4 Offences and penalties
  
  Any by-law made under section 3 may declare any breach of any such by-law to be an offence and may prescribe penalties therefor:
  
  Provided that no penalty so prescribed shall exceed a fine of five hundred dollars:
  
  Provided also that until such breaches and such penalties are so prescribed by by-law, any person who commits a breach of the by-laws made under section 3 shall be liable to a fine of five hundred dollars.

  Remarks:

  Nothing in this Ordinance shall affect or be deemed to affect the rights of the Central Authorities or the Government of the Hong Kong Special Administrative Region under the Basic Law and other laws, or the rights of any body politic or corporate or of any other persons except such as are mentioned in this Ordinance and those claiming by, from or under them.
