| To provide for the incorporation of the Bishop of the Roman Catholic Church in Hong Kong. (Amended 64 of 1948 s.2) [15 May 1885] (Originally 10 of 1885 (Cap 266 1950)) Cap 1003 s 1 Short title This Ordinance may be cited as the Bishop of the Roman Catholic Church in Hong Kong Incorporation Ordinance. (Amended 5 of 1924 s.6; 64 of 1948 s.2) Cap 1003 s 2 Incorporation The Bishop of the Roman Catholic Church in Hong Kong, and his successors in the office of Bishop of the Roman Catholic Church in Hong Kong, shall be a corporation sole, hereinafter called "the corporation", and shall have the name "The Catholic Diocese of Hong Kong (天主教香港教区)", and in that name shall have perpetual succession, shall be capable of suing and being sued, and shall have a common seal. (Replaced 40 of 1975 s. 2. Amended 88 of 1993 s. 2) Cap 1003 s 2A Powers of the corporation Remarks: Adaptation amendments retroactively made - see 33 of 1999 s. 3 (1) Subject to subsection (3), the corporation shall have the following powers- (a) to acquire, lease, hold and enjoy any land or buildings on such terms as it thinks fit; (b) to invest its money- (i) on deposit at any bank, whether in Hong Kong or elsewhere; or (ii) in the stocks, shares, or securities of any corporation carrying on business either in Hong Kong or elsewhere;(c) to purchase, hire or acquire any movable property; (d) to sell, lease or otherwise dispose of, and to charge, any of its property on such terms as it thinks fit; (e) to develop or turn to account any of its immovable property in such manner and on such terms as it thinks fit; (f) to borrow money for the corporation's purposes and to charge all or any of its property.(2) The powers conferred on the corporation by subsection (1) may be exercised either alone or jointly with one or more other persons. (3) In respect of land and buildings- (a) acquired with public money; or (b) granted by the Government for any special purpose,prior to the commencement of this Ordinance, the powers conferred on the corporation by subsection (1)(d), (e) and (f) shall not be exercised except with the consent of the Chief Executive in Council. (Amended 33 of 1999 s. 3) (Added 40 of 1975 s. 2) Cap 1003 s 3 Saving Remarks: Adaptation amendments retroactively made - see 33 of 1999 s. 3 Nothing in this Ordinance shall affect or be deemed to affect the rights of the Central Authorities or the Government of the Hong Kong Special Administrative Region under the Basic Law and other laws, or the rights of any body politic or corporate or of any other persons except such as are mentioned in this Ordinance and those claiming by, from or under them.
