(Cap 478 section 74(2)) [2 September 1996] L.N. 342 of 1996 (L.N. 7 of 1996) Cap 478Z s 1 (Omitted as spent) (Omitted as spent) (Enacted 1996) Cap 478Z s 2 Interpretation In these Rules, unless the context otherwise requires- "approved" (认可) means approved by the Authority; "certificate of proficiency in fast rescue boats" (快速救援艇熟练操作证书) means a certificate issued under section 4A; (L.N. 106 of 1998) "certificate of proficiency in survival craft and rescue boats" (救生艇筏及救援艇熟练操作证书) means a certificate issued under section 4; (L.N. 106 of 1998) "Examination Centre" (考试中心) means the Examination Centre of the Marine Department; "examiner" (主考人员) means a person appointed to be an examiner under section 74(1) of the Ordinance; "fast rescue boat" (快速救援艇) means a boat complying with the requirements of the Guidelines for Fast Rescue Boats adopted by the International Maritime Organization by resolution A.656(16); (L.N. 106 of 1998) "rescue boat" (救援艇) means a boat designed to rescue persons in distress and to marshal survival craft; (L.N. 106 of 1998) "responsible authority" (负责当局), in relation to a training school or course, means the person in charge of that school or course, as the case may be "survival craft" (救生艇筏) means a craft capable of sustaining the lives of persons in distress from the time of abandoning the ship. (L.N. 106 of 1998) (Enacted 1996) Cap 478Z s 3 Conditions for the grant of a certificate of proficiency in survival craft and rescue boats (1) An applicant for a certificate of proficiency in survival craft and rescue boats shall have- (L.N. 106 of 1998) (a) attained 18 years of age; (b) attended an approved basic sea survival course; (c) completed sea service of not less than 12 months, or such shorter period as the Authority may allow having regard to the applicant's completion of an approved survival craft training course; (d) satisfied an examiner by practical demonstration, as required, of his ability to carry out the tasks listed in Part I of Schedule 1; (e) satisfied an examiner that he is familiar with the matters relating to launching and operation of survival craft, rescue boats and survival at sea listed in Part II of Schedule 1; and (f) satisfied an examiner that he has sufficient knowledge of the English language to understand, or give, any necessary orders that may be given to or by him in the course of his duties in connection with survival craft and rescue boats.(2) Every application to take an examination for a certificate of proficiency in survival craft and rescue boats shall conform with the provisions of Schedule 2. (L.N. 106 of 1998) (Enacted 1996) Cap 478Z s 3A Conditions for the grant of a certificate of proficiency in fast rescue boats (1) An applicant for a certificate of proficiency in fast rescue boats shall hold a certificate of proficiency in survival craft and rescue boats and shall have- (a) attained 18 years of age; (b) attended an approved training course; (c) satisfied an examiner by practical demonstration, as required, of his ability to carry out the tasks listed in Part I of Schedule 1A; (d) satisfied an examiner that he is familiar with the matters relating to the launching and operation of fast rescue boats listed in Part II of Schedule 1A; and (e) satisfied an examiner that he has sufficient knowledge of the English language to understand, or give, any necessary orders that may be given to or by him in the course of his duties in connection with fast rescue boats.(2) Every application to take an examination for a certificate of proficiency in fast rescue boats shall conform with the provisions of Schedule 2. (L.N. 106 of 1998) Cap 478Z s 4 Issue of certificate of proficiency in survival craft and rescue boats (1) Subject to subsection (2), the Authority shall, if satisfied that the applicant has fulfilled the requirements of section 3, issue a certificate of proficiency in survival craft and rescue boats upon payment of the prescribed fee. (2) Before issuing a certificate of proficiency in survival craft and rescue boats, the Authority may require the applicant to produce to him certificates or other documents showing to his satisfaction that the applicant has fulfilled the requirements of section 3. (L.N. 106 of 1998) (3) (Repealed L.N. 106 of 1998) (4) Any applicant aggrieved by a decision of the Authority to refuse to issue him a certificate of proficiency in survival craft and rescue boats may appeal against the decision to the Administrative Appeals Board except where the only reason for the refusal is that the applicant has not paid the prescribed fee referred to in subsection (1). L.N. 106 of 1998) Cap 478Z s 4A Issue of certificate of proficiency in fast rescue boats (1) Subject to subsection (2), the Authority shall, if satisfied that the applicant has fulfilled the requirements of section 3A, issue a certificate of proficiency in fast rescue boats upon payment of the prescribed fee. |
