CAP 478P MERCHANT SHIPPING (SEAFARERS) (OFFICIAL LOG BOOKS) REGULATION

  Cap 478P s 2 Interpretation
  
  (1) In this Regulation, unless the context otherwise requires-
  
  "Closing of Openings Regulations" (《关闭孔口规例》) means the Merchant Shipping (Safety) (Closing of Openings in Hulls and in Watertight Bulkheads) Regulations (Cap 369 sub. leg.);
  
  "Crew Accommodation Regulation" (《船员舱房规例》) means the Merchant Shipping (Seafarers) (Crew Accommodation) Regulation (Cap 478 sub. leg.);
  
  "Disciplinary Offences Regulation" (《违纪行为规例》) means the Merchant Shipping (Seafarers) (Disciplinary Offences on Board Ships) Regulation (Cap 478 sub. leg.);
  
  "entry" (记项) means an entry in an official log book (including an entry contained in a separate document annexed to any official log book in accordance with section 6) of any particulars specified in column 1 in any paragraph of the Schedule and an entry amending or cancelling such an entry;
  
  "Musters Regulations" (《召集规例》) means the Merchant Shipping (Safety) (Musters and Training) Regulations (Cap 369 sub. leg.);
  
  "Pilot Ladders and Hoists Regulations" (《领航员梯及吊重机规例》) means the Merchant Shipping (Safety) (Pilot Ladders and Hoists) Regulations (Cap 369 sub. leg.);
  
  "Repatriation Regulation" (《遣返规例》) means the Merchant Shipping (Seafarers) (Repatriation) Regulation (Cap 478 sub. leg.);
  
  "ship" (船、船舶) means a Hong Kong ship;
  
  "Steering Gear Regulations" (《操舵装置规例》) means the Merchant Shipping (Safety) (Automatic Pilot and Testing of Steering Gear) Regulations (Cap 369 sub. leg.);
  
  "tons" (吨) and "tonnage" (吨位) mean "tons" and "tonnage" as calculated in accordance with the Merchant Shipping (Registration) (Tonnage) Regulations (Cap 415 sub. leg.);
  
  "wages submission" (工资纠纷的提交) means a submission under section 87 of the Ordinance to the Superintendent.
  
  (2) In this Regulation, references to the gross or register tonnage of a ship are, in the case of a ship having alternative gross or alternative register tonnages, references to the larger of its gross tonnages or to the larger of its register tonnages, as the case may require.

  Cap 478P s 3 Application
  
  This Regulation shall apply to-
  
  (a) every ship to which the Merchant Shipping (Seafarers) (Crew Agreements, Lists of Crew and Discharge of Seafarers) Regulation (Cap 478 sub. leg.) applies; and
  
  (b) every ship authorized by virtue of a passenger certificate and general safety certificate issued under Part II of the Merchant Shipping (Safety) Ordinance (Cap 369) to carry passengers within river trade limits.
  
  (Enacted 1995)
  
  Cap 478P s 4 Entries in official log books
  
  Subject to the provisions of the Ordinance, the Merchant Shipping Ordinance (Cap 281), the Merchant Shipping (Safety) Ordinance (Cap 369) and any regulations made under any of those Ordinances, entries of particulars specified-
  
  (a) in column 1 in each paragraph of Part 1 of the Schedule shall from time to time be made in the official log book kept in every ship;
  
  (b) in column 1 in each paragraph of Part 2 of the Schedule shall be so made in the official log book kept in every ship in respect of which a load line certificate has been issued under section 51, or a load line exemption certificate has been issued under section 63, of the Merchant Shipping (Safety) Ordinance (Cap 369); and
  
  (c) in column 1 in each paragraph of Part 3 of the Schedule shall be so made in the official log book kept in every ship to which the Closing of Openings Regulations apply.

  Cap 478P s 5 Making, signing and witnessing of entries
  
  (1) Each entry shall be made in the official log book by the person or by one of the persons (or by a person authorized by any such person for that purpose) specified in column 2 in each paragraph of the Schedule.
  
  (2) Each entry-
  
  (a) subject to subsection (3), shall be signed by the person or by one of the persons specified in column 2 in each paragraph of the Schedule; and
  
  (b) subject to the provisions of each paragraph of the Schedule, shall be witnessed by the person, if any, specified in column 3 in each paragraph of the Schedule.(3) An entry which is to be signed by the master may, except where the contrary intention appears, be signed by an officer authorized by the master for that purpose.
  
  (4) Each entry shall include the date when it is made.

  Cap 478P s 6 Annexes to official log books
  
  If it is not practicable by reason of its length, the circumstances in which it is to be made or for any other reason for an entry to be contained in the official log book, it shall be contained in a separate document annexed to the official log book and referred to in an entry in the official log book; and references in this Regulation to an official log book include references to any documents annexed to an official log book in accordance with this section.
